WILLS & ESTATES

A Will is the single most important legal document that you will ever create.  At its core, having a Will and Estate Planning is about taking care of yourself and those you love.  By having a Will in place you are able to:

  • ensure your loved ones are taken care of in the case of unexpected life events and
  • provide a legacy of love and purpose for when you are gone.

Absent a Will, the Estate laws of Ontario may end up controlling what happens to your property and possessions and that rarely aligns with what you really want.

A Will must be well planned and drafted in order to avoid any legal complications and assist in the smooth distribution of assets after the death of an individual.

POWER OF ATTORNEY

A Power of Attorney (POA) is a legal document that gives one person the power to act for another person.  It ensures you will be cared for if you are no longer able to care for yourself.  A POA differs from a Will.  A Will is effective when a person dies whereas a POA is effective when a person is living or is living and is incapacitated, either physically or mentally.

There are two types of Powers of Attorney:

  • Power of Attorney for Property
  • Power of Attorney for Personal Care

A POA for Property allows the person(s) you choose to manage your affairs and sign your name on any document that you could sign.  It allows your attorney to deal with your property on your behalf. A POA for Personal Care is also known as a Living Will and allows a person(s) you choose to take decisions regarding your health care in case you are not able to give instructions about your care.
