What is a Commissioner for Taking Affidavits?

Lawyers are commissioners for taking affidavits (also known as commissioners of oaths).  Commissioners affirm affidavits or declarations by asking their clients to swear or affirm the statements in a document is true and accurate.  Affidavits are required by all kinds of documents such as Real Estate documents and Affidavits of Execution.

In accordance with the Commissioners for Taking Affidavits Act, R.S.O. 1990, c. C.17, as amended, “Every oath and declaration shall be taken by the deponent or declarant in the physical presence of the commissioner, notary public or other person administering the oath or declaration.”
